OFF-LEASH INDOOR DOG PARK MEMBERSHIP AGREEMENT

By purchasing a membership and accessing the services of OFF-LEASH Indoor Dog Park, LLC ("Off-Leash," "we," "our," or "us"), you ("Member," "Dog Owner," or "User") agree to the following Terms and Conditions. These terms govern your use of our website, facilities, and services. If you do not agree, you may not use our services.
1. OWNERSHIP OF THE WEBSITE & SERVICES
The Off-Leash website and all content, including text, images, graphics, and branding, are the exclusive property of Off-Leash Indoor Dog Park, LLC. Unauthorized reproduction, modification, or distribution is strictly prohibited.
2. ACCEPTANCE OF RISK & LIABILITY WAIVER
By purchasing a membership and using Off-Leash’s facilities, you acknowledge and agree to the following:
Dog parks inherently carry risks, including but not limited to:
- Dog fights, bites, scratches, or aggressive behavior
- Injury to yourself, your dog(s), or others
- The spread of illness, disease, or parasites
- The risk of your dog becoming lost, stolen, or escaping
- You assume all risks associated with your and your dog’s participation at Off-Leash
- Release of Liability: You fully and permanently release Off-Leash, its owners, employees, and affiliates from any and all liability, claims, or causes of action related to injuries, illnesses, damages, or losses incurred at our facility, including those caused by negligence.
3. MEMBERSHIP REQUIREMENTS & CONDITIONS
To access Off-Leash’s facilities, all members must:
- Be at least 18 years old to register for a membership.
- Confirm that their dog(s) are up to date on rabies, Bordetella, and distemper vaccinations by agreeing to these terms and conditions. Off-Leash reserves the right to request proof of vaccination at any time. Failure to provide accurate information may result in membership suspension or termination.
- Confirm that their dog(s) have no history of aggression toward people or other dogs.
- Agree to supervise their dog(s) at all times and follow all posted rules and staff instructions.
- Release of Liability: You fully and permanently release Off-Leash, its owners, employees, and affiliates from any and all liability, claims, or causes of action related to injuries, illnesses, damages, or losses incurred at our facility, including those caused by negligence.
Zero Tolerance Policy for Aggressive Dogs
Off-Leash maintains a zero tolerance policy for aggressive dogs. Any dog that displays aggressive behavior toward people or other dogs may be temporarily suspended or permanently banned from the facility. Decisions regarding suspensions or bans are at the sole discretion of Off-Leash staff and are final.
Right to Refuse Service
Off-Leash reserves the right to refuse or revoke membership access if:
- A dog or owner fails to follow facility rules.
- A dog exhibits repeated aggression or disruptive behavior.
- A member provides false information about their dog’s health, behavior, or vaccinations.
4. MEMBERSHIP FEES, CANCELLATION & REFUNDS
- All membership fees are non-refundable once payment is processed.
- Memberships automatically renew based on the chosen plan unless canceled before the next billing cycle.
- Members may cancel their membership at any time, but no refunds will be issued for unused time.
- Off-Leash reserves the right to adjust pricing with prior notice.
5. FACILITY RULES & CONDUCT
All members must adhere to the following rules while on Off-Leash premises:
- Dogs must always be on a leash when entering and exiting the facility.
- Dogs must be under voice control at all times.
- Owners must immediately clean up after their dogs.
- Dogs that display aggressive behavior must be removed immediately.
- No outside food, treats, or toys are allowed inside the park to prevent resource guarding.
Failure to comply with these rules may result in membership suspension or termination without refund.
6. EMERGENCIES & VETERINARY CARE
- In case of an emergency, Off-Leash staff may seek veterinary care at the owner's expense if necessary.
- Off-Leash is not responsible for any medical expenses related to injuries or illnesses that occur at the facility.
- Off-Leash is not responsible for the behavior or action of any dog(s) inside the facility or any of the consequences that follow as a result of any dog(s) behavior or action towards another dog or human.
- Off-Leash is equipped with multiple methods to de-escalate aggressive situations between dogs.
- All Off-Leash staff members are trained and equipped to handle fighting dogs.
- However, an Off-Leash employee will never put themselves in harm’s way during an altercation.
- Owners are ultimately responsible for controlling their dog(s) at all times.
- Any injury to a dog involved in a fight, or any human injured as a result of that fight, is not the fault of Off-Leash or its employees.
7. PHOTOGRAPHY & MEDIA RELEASE (Optional)
By entering Off-Leash, you grant permission for Off-Leash to photograph or record you and your dog for marketing, social media, or promotional purposes.

8. MODIFICATION OF TERMS
Off-Leash reserves the right to update or modify these Terms and Conditions at any time. Members will be notified of significant changes, and continued use of services constitutes acceptance of the revised terms.
9. TERMINATION OF MEMBERSHIP
Off-Leash may terminate a membership at any time for violations of these Terms and Conditions, including:
- Failure to comply with facility rules
- Providing false or misleading information
- Engaging in disruptive or unsafe behavior
No refunds will be issued for terminations due to rule violations.
10. LOST OR STOLEN PROPERTY
Off-Leash is not responsible for lost, stolen, or damaged personal items, including those left inside the facility or parking lot.
11. GOVERNING LAW & DISPUTE RESOLUTION
This agreement shall be governed by the laws of Utah.
Any disputes shall be resolved in the courts of Cache County, Utah.
If any portion of this agreement is found to be invalid, the remaining portions shall remain in full effect.
